Evearly is a French company with no establishment in the United Kingdom. UK consumers benefit from the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; UK GDPR and the Data Protection Act 2018 govern personal data, under the supervision of the Information Commissioner's Office (ICO).

This policy explains which personal data Evearly processes when you use incarweb.app, why, for how long, with whom it is shared and what your rights are. It covers the website, the web app shown in your vehicle's browser and the pages opened on your phone (log-in and payment by QR code).

incarweb.app is designed to work without an account: your settings (language, icon layout, notes, search engine) then stay in your browser's local storage and are never sent to us. An account is only needed to sync those settings across devices, add your own links or take out the Plus subscription. We do not sell personal data and do no advertising profiling.

incarweb.app uses no advertising or tracking cookies. The cookies set are strictly necessary for the functions you request and need no consent:

Third-party cookies may be set by services embedded on some pages only: hCaptcha (contact and note-sending forms, to tell humans from bots) and Paddle (subscription and payment pages). They are governed by those providers' privacy policies (section 6).
Your browser's local storage keeps your settings without an account: language, open category, icon layout and hidden icons, notes in "on this device" mode, preferred search engine. This data never leaves your browser; clear it by deleting the site's data in your browser settings.
Should advertising ever be shown to visitors without a Plus subscription, it will only load after your express agreement through the banner, and this policy will be updated beforehand.
All data comes from you (input, browsing, settings) or from your browser (IP address, technical characteristics, position if you allow it). The country is derived from the IP address by a third-party service (section 6). When you log in via Tesla, your identifier and e-mail address are sent to us by Tesla with your agreement.
The third-party services you open from the site's icons (maps, news, video, music, social networks, shops…) are independent: as soon as you reach them, their own policies apply.
Your account data is hosted in France. Some providers are established outside the European Economic Area: Paddle in the United Kingdom (recognised as adequate by the European Commission), hCaptcha and Tesla in the United States (covered by the EU-US Data Privacy Framework or the European Commission's standard contractual clauses). You may request a copy of the applicable safeguards.
You have the right to access, rectify, erase, restrict and object to the processing of your data, to data portability, and to withdraw at any time a consent you have given (geolocation, Tesla log-in). At any time you can:
We reply within one month. We may ask you to confirm the request from the account's e-mail address.
UK GDPR and the Data Protection Act 2018 apply. If you believe your rights are not respected, you may complain to the Information Commissioner's Office (ICO), https://ico.org.uk.
Encrypted connections (HTTPS) across the whole site, hashed passwords, protected session cookies (Secure, HttpOnly), e-mail address verification at sign-up, capped log-in attempts, server access limited to authorised persons. No system is infallible; we would notify you of a data breach affecting your rights as the law requires.
The service is meant for drivers and passengers; creating an account is reserved for persons aged 14 or over (with a parent's agreement below the age set by your country's law to consent alone to an online service) and the Plus subscription for persons aged 17 or over. We do not knowingly collect data from younger persons and delete any account reported to us as such.
This policy may change with the service. The revision date is shown below; a substantial change is announced on the site and, to account holders, by e-mail where the law requires it.

These terms of use ("Terms") govern access to and use of the incarweb.app website and web app (the "Service"), published by Evearly ("we", "us"), whose details appear in the Legal notices. By using the Service, and all the more by creating an account, you accept these Terms and the Privacy Policy. The paid "Plus" subscription is also subject to the Terms of Sale.
The Service is a home page designed for the browser of connected vehicles: it gathers, as icons sorted by category, shortcuts to third-party sites and services (maps, news, video, music, podcasts, games, social networks, shops…) plus a few tools of its own: notepad, sending notes by e-mail, local weather, GPS timer (Takynos), unit conversion, display adapted to the vehicle screen. The Service can be used without an account; a free account syncs your settings and lets you add your own links; the Plus subscription extends those possibilities (see section 4).
The Service must never be operated by the driver of a moving vehicle. You alone are responsible for complying with traffic law and the rules on screen use in the country and state where you drive. The "Allowed", "L3" or similar markers shown next to some icons are general informational cues with no legal value; they do not replace checking local regulations or keeping control of the vehicle. The Takynos timer is intended for circuits, tracks and authorised private grounds: any measurement on public roads is your sole responsibility. To the extent permitted by law, Evearly accepts no liability for damage resulting from use of the Service while driving.

Plus account (paid): everything in the free account, unlimited links by URL, notes by e-mail without captcha up to 6
per hour and 10 per day, no advertising.
To create an account you must be at least 14 years old (with a parent's agreement where your country's law sets a higher age to consent alone to an online service), provide a valid e-mail address that you verify by clicking the link you receive, and choose a password of at least six characters. You may also sign up or log in with your Tesla account. You are responsible for keeping your credentials confidential and for all activity under your account; tell us promptly of any unauthorised use. An account is personal and may not be shared or transferred.
These limits and quotas may be adjusted; they are always shown in the app ("My account", subscription page).
The Service's icons link to sites and services run by third parties over which Evearly has no control. Their availability, content, terms, prices and data practices are their own; some may refuse to display inside a frame or in a vehicle browser. The trademarks and logos shown belong to their owners; their presence implies no partnership or endorsement, either by those third parties or by Evearly. The Service is not affiliated with Tesla or any vehicle manufacturer.
You may add your own links (address, title, icon). You warrant that you hold the necessary rights and undertake not to add links to unlawful, infringing, malicious content or content contrary to public order. Those links are visible only to you; Evearly may nevertheless remove them and suspend the account upon report or obvious abuse. The notes you write remain yours; you grant us only the technical licence needed to store them, display them and send them to the address you specify.
You must not: circumvent the Service's quotas, limits or security mechanisms (captcha, address verification, log-in caps); access the Service by automated means other than browsers without written agreement; use the note-sending feature for unsolicited mail; attempt to access other people's accounts or data; disrupt the servers; reproduce or resell the Service.
The Service, its code, structure, texts, own icons and the "IncarWeb" name are protected. These Terms grant you a personal, non-exclusive, non-transferable right of use, with no transfer of ownership. Any open-source code included remains governed by its own licences.
The Service is provided "as is" and as available. We do not warrant that it works on every vehicle, browser or software version, nor that it is free of interruptions: maintenance, updates, incidents at the host or at a third party. We may change, add or remove features and links; essential features of the Plus subscription will not be removed during a paid period without the subscriber being able to cancel and be refunded for the remaining period. A permanent shutdown of the Service would be announced to account holders at least 30 days in advance.
Processing is described in the Privacy Policy, which forms part of these Terms.
Evearly owes a best-efforts obligation. To the extent permitted by applicable law, its liability is limited to direct and foreseeable damage resulting from a breach attributable to it and, for Plus subscribers, to the amount paid over the last twelve months. It is not liable for third-party content, services and outages, nor for damage resulting from use contrary to these Terms (in particular section 3). Nothing in these Terms limits liability for gross negligence or wilful misconduct, for death or personal injury, or the rights that consumer protection laws grant you mandatorily.
You may stop using the Service at any time and ask for your account to be deleted through the contact form (see the privacy policy for details). We may suspend or close an account for a serious or repeated breach of these Terms, after notice by e-mail where possible, or immediately where security is at risk. The consequences for a running subscription are described in the Terms of Sale.
We may amend these Terms to reflect changes in the Service or the law. The version in force is the dated one published on the site; a substantial change is announced on the site and, to account holders, by e-mail at least 15 days before it takes effect. Continuing to use the Service after that date means acceptance; otherwise you may close your account.
These Terms are governed by French law, without prejudice to the mandatory consumer protection rules of the United Kingdom (Consumer Rights Act 2015 in particular), which prevail. If a problem arises, contact us first: most issues are settled by a simple exchange. Consumers resident in the UK may bring proceedings before the courts of England and Wales, Scotland or Northern Ireland according to their place of residence, or before the French courts.

These terms of sale ("Terms of Sale") apply to the purchase of the paid "Plus" subscription to the incarweb.app service (the "Service") by a consumer or a business ("you"). They supplement the Terms of Use, which continue to govern use of the Service. By confirming an order you accept the Terms of Sale in force on that date.
The Service is developed, operated and provided by Evearly, société par actions simplifiée (SAS, simplified joint-stock company under French law), Grindanes, 13122 Ventabren, France, RCS Salon-de-Provence 833 041 643, VAT FR 63 833041643 (full details in the Legal notices).
The sale itself — collecting payment, invoicing, calculating and remitting taxes, refunds — is carried out by our authorised reseller Paddle.com Market Limited, Judd House, 18-29 Mora Street, London EC1V 8BT, United Kingdom, acting as merchant of record. Paddle is therefore the name on your bank statement and the issuer of your invoice, and its buyer terms apply to the payment transaction. These Terms of Sale govern everything else: what the Service includes, its duration, cancellation and your remedies. For any question you may contact either Evearly or Paddle (paddle.net); we coordinate.
For its duration, the Plus subscription gives access, on top of the free account, to: unlimited links added by URL; sending notes by e-mail without captcha, up to 6 per hour and 10 per day; no advertising. The features are summarised on the subscription page before you order. The Service is a digital service supplied continuously; no physical medium is involved.
Reference prices are 9 € per quarter or 33 € per year, tax included, for a buyer located in France. For other countries, the price shown on the subscription page is computed by Paddle in your currency, with the taxes applicable in your country included or shown separately according to local rules; the price displayed when you confirm the order is the price charged. The amount is charged at subscription and at each renewal. A price change applies only to renewals following at least 30 days' notice by e-mail; you may then cancel free of charge before the renewal.
Subscribing requires a verified account and being at least 17 years old. From the subscription page you choose the billing period (quarterly or yearly), review the summary, then pay in the Paddle checkout — on the vehicle screen or, by scanning the QR code, on your phone. The order is final when Paddle confirms the payment; you receive a confirmation e-mail and Paddle's invoice, and the subscription is activated on your account within seconds (reload the page if needed). You can change your choice up to the moment the payment is confirmed.
Accepted methods depend on your country: payment card, Apple Pay, Google Pay, PayPal and other methods offered by Paddle. Payment details are entered with Paddle; Evearly never has access to them. If a renewal charge fails, Paddle retries and informs you; failing settlement within the stated period, the subscription ends and the account reverts to the free plan.
The subscription is taken out for the chosen period (3 or 12 months) and renews automatically for the same period, at the then-current price, unless cancelled before the renewal date. That date is shown in "My account" and on the subscription page.
You may cancel at any time, without reason or charge, from "Manage my subscription" (Paddle customer portal) or by writing to us. Cancellation takes effect at the end of the period already paid: you keep all Plus features until then and no further charge is made. Apart from the withdrawal right (section 8) and the cases in section 10, the current period is not refunded pro rata.
What happens to your links after the subscription ends. The account reverts to the free plan: only your first 3 links added by URL (the oldest, excluding deleted ones) remain accessible. The others are hidden but kept for 6 months so that a new subscription finds them again; after that they are permanently deleted. You are warned before cancelling and by e-mail at cancellation, and you may delete links to choose which ones to keep.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have 14 days from subscribing to cancel without giving a reason. As the Service starts immediately, by confirming the order you expressly request that supply begin within the cancellation period; for simplicity, Evearly nevertheless refunds in full any cancellation exercised within 14 days, with no deduction for the service already supplied. This right does not apply to renewals of a running subscription.
How to exercise it: write to us through the contact form or at dirpub1 @ evearly.com, or contact Paddle (paddle.net), giving the account's e-mail address and the subscription date, before the period expires. You may use the wording: "I hereby give notice that I cancel the Plus subscription taken out on [date] for the account [e-mail address]". The refund is made by Paddle to the payment method used, free of charge, no later than 14 days after receipt of the request. Plus access ends at that point.
As a consumer you benefit from the Consumer Rights Act 2015 regarding digital content and services: the Service must match its description and remain so for the whole subscription, updates included. Where it does not, you may require it to be brought into conformity and, failing that, a price reduction or termination with a refund of the remaining period. These rights are exercised with Evearly, free of charge.
We may change the Service. If an essential feature of the Plus offer is removed during a paid period, or if the Service is discontinued, you are informed by e-mail at least 30 days in advance and may cancel immediately with a pro-rata refund of the unused period.
Section 11 of the Terms of Use applies. It does not limit the rights you mandatorily hold under consumer protection laws, nor liability for death or personal injury, gross negligence or wilful misconduct.
The data processed for the subscription (Paddle identifiers, payer name and e-mail, amounts, dates) is described in the Privacy Policy. Paddle processes your payment data as an independent controller.
The Terms of Sale that apply are those in force on the day of the order or renewal. Any change is notified to you by e-mail at least 30 days before the next renewal; you may cancel before that date if you do not accept it.
These Terms of Sale are governed by French law, without prejudice to the mandatory consumer protection rules of the United Kingdom, which prevail. Contact us first with any complaint. We are not obliged to use an alternative dispute resolution body, but will consider one in good faith. Consumers resident in the UK may bring proceedings before the courts of their part of the UK or before the French courts.
